The
controversy over the construction of a building in the Piton
Management Area (PMA) and who gave the permission to build
continues unabated with the opposition Saint Lucia Labour
Party producing documented evidence absolving itself from
accusations that it gave the go ahead to build when it gave
an Alien Landholding Licence to Marco and Jessica Mignucci
back in 2006.
Dr. Kenny Anthony, political leader of the Labour Party, at
the same time said that it was now clear that Physical Planning
Minister Richard Frederick either lied or chose to be misinformed
about the matter.
Dr. Anthony yesterday produced a copy of the Alien Landholding
Licence that was given to the Mignucci’s in 2006 by
his administration in which stated thus:
“The issuance of this license does not by itself permit
the licence holder to build on or develop the property. For
such purposes further application must be made to the Development
Control Authority and the requisite approval must be granted
before commencement of such building or development”.
This was the final clause in the licence given to the Mignucci’s,
a copy of which is in the possession of The VOICE.
“This paragraph confirms the explanation of the Saint
Lucia Labour Party. It is clear that Minister Richard Frederick
either lied or chose to be misinformed about the actual content
of the Alien’s Landholding Licence granted to the Mignucci’s,”
Dr. Anthony said.
“Now
that this issue has been clarified, one fundamental question
needs to be answered: On whose permission, authority or advice
did the Mignucci’s proceed to build on the site?”
Dr. Anthony asked.
This question comes into sharper focus demanding answers when
Cabinet Conclusion No.362 of 2007, dated 10th May, 2007 deferred
applications to develop land within the PMA.
Cabinet Conclusion 362 of 2007 considered a Memorandum dated
7th May, 2007 submitted by the Ministry of Physical Development
and approved the following, pursuant to Section 25 (3) of
the Physical Planning and Development Act of 2001:
That the development applications listed in Appendix A to
these Minutes be deferred pending the adoption of an Integrated
Development Plan for the PMA and the Soufriere region by the
Cabinet of Ministers.
And that all subsequent development applications submitted
to the Development Control Authority in respect of lands within
the PMA are to be deferred pending the adoption of an Integrated
Development Plan for the area by the Government of Saint Lucia.
For avoidance of doubt this decision is also applicable to
applications for approval in principle.
The Cabinet Conclusion 362 of 2007 also stated that applications
to renovate and extend facilities on lands owned by Jalousie
(1996) Ltd. located within the PMA are exempted from this
Conclusion.
The question still remains: Who gave permission or advice
to the Mignucci’s that they could go ahead and construct
or continue their construction?
